1.1 Terms of Service Agreement

1.2 Related Agreements

These Terms incorporate by reference our Privacy Policy, Content License Agreement, and Acceptable Use Policy (collectively, the "Related Agreements"). Together, these Terms and the Related Agreements govern your access to and use of the Service. In case of conflict, these Terms shall prevail, except for the following matters:

• Content ownership, licensing, and usage rights (Content License Agreement)
• Privacy and data handling (Privacy Policy)
• Permitted and prohibited activities (Acceptable Use Policy)

By using the Service, you agree to these Terms and all Related Agreements.

The Service provides an AI powered platform for transforming pet photographs through various editing and creative features. Features and functionality may vary based on subscription tier and are subject to change. Current features are described on our website and within the Service.

3.1 Account Creation

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep this information updated. You allow us to use the information to communicate with you about our Service.

3.2 Account Security and Sharing

• You are prohibited from sharing your account credentials with any other person or entity
• You may not transfer, sell, or lease your account to any third party
• You may not make your account available to anyone else
• You must use reasonable efforts to prevent unauthorized access to your account

3.3 Account Responsibility

You are solely responsible for all activities that occur under your account, whether or not you authorized them. Any actions taken through your account will be deemed to have been taken by you.

3.4 Security Breach Notification

You must notify us immediately at legal@pawfav.ai if you become aware of any unauthorized use of your account, discover any security breach, or suspect your credentials have been compromised.

3.5 Account Recovery and Protection

You are responsible for keeping your account recovery information current and accurate. PawFav reserves the right to implement additional security measures at any time.

4.1 Age Requirements

You must be at least 14 years old to use the Service. The Service is not intended for children under 14, and we do not knowingly collect personal information from children under 14. If you are at least 14 but not yet 18, you represent that you have received permission from your parent or legal guardian.

4.2 Parental/Legal Guardian Consent for Minor Users

If you are a parent or legal guardian who has provided consent for a minor (at least 14 but not yet 18) to use the Service, you agree to supervise and be responsible for their use, acknowledge our data practices, accept full responsibility for their compliance with these Terms, and acknowledge that some content may be inappropriate for minors.

4.3 Account Restrictions

You may not create an account or use the Service if you have been previously banned or suspended.

4.4 AI Training

We do not use your uploaded content or AI generated content for AI training purposes without your permission.

5.1 Use of the Service

You may access and use our Service only in compliance with these Terms, our Acceptable Use Policy, our Privacy Policy, our Content License Agreement, and any guidelines we may post. You may not:

• Use the Service in any manner that violates any applicable law or regulation
• Develop competing products or services, or train AI models using our Service
• Decompile, reverse engineer, or disassemble our Service
• Crawl, scrape, or harvest data from our Service
• Obtain unauthorized access to any system or information
• Infringe or violate intellectual property or other legal rights
• Access the Service through automated or non human means

5.2 Sharing Functionality

Our Service enables you to share AI generated content using your device's native sharing interface. We do not establish direct connections with social media platforms. The available sharing destinations depend on the applications installed on your device.

6.1 Subscription and Renewal

By subscribing, you authorize us to charge your payment method for subscription fees, including applicable taxes. Subscriptions automatically renew unless canceled at least 24 hours before the renewal date.

6.2 Pricing

Current prices are displayed in the app and on our website. We reserve the right to change prices upon reasonable notice. Changes apply to your next renewal period.

6.3 Cancellation

You may cancel your subscription at any time through your account settings or the platform where you subscribed. Cancellation takes effect at the end of the current billing period.

6.4 Refunds

We do not provide refunds except where required by applicable law.

6.5 Failed Payments

If a payment fails, your access may be suspended until valid payment information is provided.

7.1 Content Ownership

You retain all ownership rights to content you upload. PawFav claims no ownership of your uploaded content.

7.2 License Grant

By uploading content, you grant us a worldwide, non exclusive, royalty free license to use, modify, publicly display, reproduce, and distribute such content solely for providing and improving the Service. We will not use your uploaded content for AI training without your permission.

7.3 User Representations

You represent that you own or have the necessary rights to the content you upload, your content does not violate any third party rights, and your content complies with these Terms and applicable laws.

8.1 Ownership Rights

You receive full usage rights in AI generated content you create. PawFav claims no ownership interest. Your rights include personal use, commercial use, distribution, and creation of derivative works.

8.2 Nature of AI Generated Content

Results may not be unique. Similar prompts may produce similar results. The copyright status of AI generated content continues to evolve under law.

8.3 Your Responsibilities

You are solely responsible for your use of AI generated content. You must ensure your use complies with applicable laws. You should not misrepresent AI generated content as human created.

8.4 No Warranty

We make no warranties about the uniqueness or originality of outputs. You assume all risks associated with using AI generated content.

8.5 Content Monitoring

We reserve the right to use automated systems, artificial intelligence, and human review to monitor, scan, and moderate content uploaded to or generated through our Service.

9.1 Output Accuracy

AI generated outputs may not always be accurate and may contain material inaccuracies. Generated images may contain inconsistencies, visual artifacts, or unexpected variations.

9.2 User Verification Responsibility

You agree to exercise your own judgment when using outputs. You are solely responsible for ensuring AI generated content is accurate, suitable for your intended use, and compliant with all applicable laws.

9.3 No Professional Advice

Outputs should not be considered professional advice. PawFav is not responsible for any decisions you make based on the Service's outputs.

9.4 Indemnification for Output Usage

You agree to indemnify and hold PawFav harmless from any claims arising from your reliance on or use of AI generated outputs.

Our Service may use or be used in connection with third party content, services or integrations. We do not control or accept responsibility for any loss or damage that may arise from your use of any third party services. Your use is at your own risk and subject to applicable third party terms. Our sharing functionality is implemented through your device's native mechanisms, not through direct integrations.

We may update the Service at any time without advance notice. Mobile app updates may be delivered automatically or require manual installation through your device's app store.

You agree not to:

• Upload content that is illegal, harmful, threatening, abusive, or objectionable
• Attempt to bypass security measures or access unauthorized areas
• Use the Service to generate content that infringes on third party rights
• Reverse engineer or extract the source code of our Service
• Use the Service for any illegal or unauthorized purpose

We strive to ensure Service availability but do not guarantee uninterrupted access. We may add, change, or remove features at any time. If you are on a paid subscription and we discontinue the Service, we will provide a substantially similar service or a pro rata refund. We may modify these Terms at any time with reasonable advance notice of material changes.

14.1 Termination by Company

We may terminate or suspend your account immediately for any violation of these Terms.

14.2 User Termination

You may terminate your account at any time by contacting us. Account termination is immediate and irreversible.

14.3 Termination Effects

Your right to access and use the Service ceases immediately. You retain ownership and usage rights to AI generated content created before termination. Uploaded content will be deleted within 30 days in accordance with our Privacy Policy.

14.4 Survival

Intellectual property rights, confidentiality obligations, indemnification obligations, dispute resolution provisions, and liability limitations survive termination.

YOUR USE OF THE SERVICE AND MATERIALS IS SOLELY AT YOUR OWN RISK. THE SERVICE AND OUTPUTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.

IN NO EVENT WILL THE PAWFAV PARTIES BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR OTHER DAMAGES ARISING OUT OF THE SERVICE OR THESE TERMS.

THE PAWFAV PARTIES' TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE SIX MONTHS PRECEDING THE DATE SUCH DAMAGES FIRST AROSE.

YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE PAWFAV PARTIES FROM AND AGAINST ANY LIABILITIES, CLAIMS, DAMAGES, EXPENSES, AND LOSSES ARISING FROM YOUR BREACH OF THESE TERMS, YOUR USE OF THE SERVICE, YOUR VIOLATION OF LAW OR THIRD PARTY RIGHTS, OR ANY FRAUD OR MISCONDUCT.

THE LAWS OF SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES OR CERTAIN TYPES OF DAMAGES, SO SOME OR ALL OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

These Terms are governed by the laws of the State of California. Disputes must first be attempted to be resolved through informal negotiations within thirty (30) days. If that fails, all disputes shall be resolved by binding arbitration administered by JAMS in San Jose, California. All disputes must be brought individually. Claims must be filed within one (1) year.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect. By using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms.

1. Introduction

This Privacy Policy describes how PawFav collects, uses, processes, and shares your information when you use our Service. We are committed to protecting your privacy and handling your data transparently. This Policy incorporates by reference our Terms of Service, Content License Agreement, and Acceptable Use Policy. In case of conflict, this Privacy Policy shall prevail for data related matters.

2. Information We Collect

Information You Provide: Account information (email, password, profile), pet photos, text descriptions, sharing activity timestamps, and customer support messages.

Payment Information: Transactions are processed entirely by your device's app store. We do not collect or store your payment information.

Information Automatically Collected: Log data, purchase verification data (transaction identifiers, subscription status), and content monitoring data (automated scan results and safety assessments).

3. How We Use Your Information

We use your information for core service functionality (processing AI images, content moderation, managing your photo library, verifying subscriptions, providing support), service improvement (analyzing performance, developing features, enhancing experience), and communication (service updates, responding to inquiries, marketing with consent, security alerts).

4. Data Processing and AI Systems

We use your uploaded content solely to provide and improve the Service. We do not use your content for AI training without your permission. Your content remains your property. We maintain encryption for all data transfers, regular security assessments, continuous monitoring, and strict internal access controls.

5. Data Sharing and Disclosure

Social media sharing is user initiated. We share data with trusted service providers for cloud storage, payment processing, analytics, customer support, and email communications. We may disclose information to comply with legal obligations, protect rights and safety, prevent fraud, or respond to valid legal requests.

6. Data Retention

Account information is maintained while active. Uploaded photos are stored until deleted by you or upon termination. Usage data is retained for 12 months. Transaction records are kept for 7 years. Communication history is maintained for 2 years. See the Account Deletion section for full termination details.

7. Data Security

We maintain encryption, secure cloud infrastructure, regular security assessments, access controls, and employee training. In case of a data breach, we will notify affected users promptly and take measures to prevent future incidents.

8. User Rights and Choices

You have the right to access your personal information, correct inaccurate data, request deletion, download your data, and opt out of marketing. Contact legal@pawfav.ai with identity verification. We respond within 5 business days.

9. International Data Transfers

Data may be processed in multiple countries. We ensure appropriate safeguards, comply with data transfer regulations, and use standard contractual clauses.

10. Age Restriction

Our Service is intended for users 14 and older. Users under 14 are prohibited. Users 14 to 17 must have parent or guardian consent. We do not knowingly collect information from persons under 14. If we discover an underage user, we will terminate their account and delete their information.

11. Changes to This Policy

We may update this policy from time to time. Material changes will be communicated via the Service or email. Continued use implies acceptance. Previous versions available upon request.

13. Jurisdiction

This Privacy Policy is governed by the laws of California, applicable federal laws of the United States, and any applicable international data protection laws.

3. Permitted Use

You may upload original photos of pets, provide text descriptions for AI generation, download AI modified images, share images using your device's native sharing functionality, and store and manage generated images. We do not use your content for AI training without your permission.

4. Prohibited Content and Activities

Prohibited Content. You may not upload or request content that contains human subjects as the primary focus, depicts non pet animals, shows animal abuse or violence, incites violence or hatred, compromises privacy or identity, engages in illegal activity, creates harmful content, spreads misinformation, facilitates fraud, infringes intellectual property, contains adult content, or includes brand logos or commercial watermarks.

Prohibited Activities. You may not create misleading AI images, manipulate the AI to generate prohibited content, use automated scripts for bulk generation, create multiple accounts to circumvent limits, or create fake profiles.

5. Technical Requirements

Photos: JPEG, PNG, HEIF formats. Max 15MB. Min 768x576 pixels. Max 4096x4096 pixels. Clear, well lit images.

Text Descriptions: Max 250 characters. English language only. No prohibited content.

6. Account Security

You must maintain a valid email address and strong password. Keep credentials confidential. Report unauthorized use or security breaches. Manage sharing settings responsibly.

7. Social Media Sharing

Respect platform content policies. Do not misrepresent AI images as original photos. Comply with each platform's terms of service. Use appropriate disclosures. Remove content if requested.

8. Enforcement

We reserve the right to review content, monitor requests, investigate violations, remove content, and restrict privileges. Violations may result in account suspension or termination, content removal, or feature restriction.

This Content License Agreement governs rights and permissions regarding content uploaded to, created by, or shared through PawFav's Service. It incorporates by reference our Terms of Service, Privacy Policy, and Acceptable Use Policy. In case of conflict, this Agreement prevails for content ownership, licensing, and usage rights.

2. User Eligibility

Your use of this Service and the licenses you grant are subject to the eligibility requirements in our Terms of Service. We reserve the right to terminate your account if you do not meet eligibility requirements.

3. User Content

Ownership. You retain all ownership rights to your uploads. PawFav claims no ownership. You may delete your content at any time.

License to PawFav. By uploading, you grant PawFav limited rights to process content through our AI systems, display it in your account, and create technical copies for service operation. This license terminates when your content is deleted. We do not use content for AI training without permission.

Representations. You own or have licenses for all content. Your content does not infringe third party rights. You have obtained all necessary permissions.

Moderation. PawFav may use automated systems or human review to moderate content. This does not grant rights beyond moderation, security, and legal compliance.

4. AI Generated Content

Ownership. To the extent copyright exists, you own all rights in AI generated content you create. PawFav makes no ownership claim. The legal status of AI generated content is evolving. PawFav retains rights in its underlying technology but not in your outputs.

Your Rights. You may use, reproduce, modify, distribute, create derivative works, license, sell, or transfer your AI generated content for personal or commercial use.

Responsibilities. You must ensure your prompts and uploads do not infringe third party rights. You must comply with applicable laws. Similarity to existing works may occur unintentionally. Verify content before commercial use. Obtain legal advice for high value uses.

Restrictions. You may not use content to infringe rights, misrepresent its AI nature, create source confusion, use it in pornographic or defamatory content, use it illegally, reverse engineer AI through outputs, or create derivative AI models.

AI Training Opt In. PawFav will not use your content for AI training without permission. You may opt in through account settings. If you do, you grant a non exclusive, perpetual, worldwide license for AI model training and improvement.

5. Social Media Sharing

You authorize us to initiate your device's native sharing functionality. We do not maintain direct connections with sharing destinations. Once sharing is initiated, content is processed by your device's operating system and the destination app. You must comply with third party platform terms.

6. Content Removal

You may delete your photos and AI generated images at any time. We reserve the right to remove content that violates this Agreement, infringes rights, violates laws, or is reported as inappropriate.

7. Termination

Upon termination, you retain intellectual property rights in content created before termination. Your license to create new content terminates immediately. You may continue to use, sell, license, and distribute previously created content. You may request deletion of uploads within 30 days.

8. Indemnification

You agree to indemnify and hold harmless the Company from claims arising from your content, your use of AI generated content, violations of this Agreement, infringement of third party rights, products or services created using AI content, regulatory compliance issues, or misrepresentation of the relationship with our Service.

9. Modifications

We may modify this Agreement at any time. Material changes will be communicated. Continued use constitutes acceptance. Previous versions available upon request.

10. Governing Law

This Agreement is governed by the laws of California. Disputes must first attempt informal resolution within 30 days. If that fails, binding arbitration by JAMS in San Jose, California. All disputes must be individual. Claims must be filed within one year.

12. Limitation of Liability

The Service is provided "as is" without warranties. Total aggregate liability shall not exceed the amount you paid in the six months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

We make no representations that AI generated content is suitable for any particular use, the Service will meet specific requirements, generated content will be original or unique, or the Service complies with specific industry standards or regulations.
